This Daimler Truck North America LLC Privacy Statement (“Privacy Statement”) explains how your Personal Information (defined below) is collected, used, shared, and processed by Daimler Truck North America LLC and its affiliates (“DTNA,” “we,” “us,” and “our”) via the use of our products and services, your interactions with us, and your visit to our internet sites, Daimlertrucknorthamerica.com and other DTNA sites that link to this Privacy Statement (the “Sites,” collectively, the “Services”). Your privacy is important to us and we want you to feel comfortable visiting the Sites and using the Services. Protecting your privacy in the processing of your personal information, including information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws and does not include data that has been effectively irreversibly anonymized or aggregated so that it can no longer enable us or others, whether in combination with other information or otherwise, to identify an individual (“Personal Information”), is an important concern to which we pay special attention.

Please read this policy carefully to understand our policies and practices regarding your Personal Information and how we treat it. If you do not agree with our policies and practices, your choice is not to use the Services. By using or accessing the Services, you are consenting to the Personal Information collection and use practices described in this Privacy Statement.

We may change this Privacy Statement from time to time, to reflect how we process your data, and if we make changes, we will post a new Privacy Statement on our Sites and change the date at the top of the Privacy Statement. If we make changes that materially affect your privacy rights, we will attempt to provide advanced notice (in nearly contemporaneous disclosures) or otherwise via the Sites, or by some other means of contact so that you have a reasonable opportunity to review the changes before you continue to use the Services. If you do not agree with a future, modified version of this Privacy Statement, then please stop using the Services at such future time. We encourage you to check the date of our Privacy Statement whenever you visit any of our Sites for any updates or changes. Your continued use of the Services after we make changes is deemed acceptpersance of those changes.

DTNA processes two categories of Personal Information:

  1. Personal Information that our partners and customers ask us to process on their behalf (“Service Provider Data”). Under applicable law, in certain contexts DTNA is considered the “processor” or “service provider” of Personal Information we receive through the Services, and our customer is (or acts on behalf of) the “controller” of the data (i.e., the company with the right to decide how the data is used).
  2. Personal Information that we collect or process for our own business (“Controller Data”).

This Privacy Statement applies to our handling of Controller Data. Our obligations with respect to Service Provider Data are covered under the agreement we enter into between us and each of our business partners and customers. If you are a user of any Services provided by DTNA on behalf of a customer, for which DTNA may obtain Service Provider Data, please direct your concerns or privacy related questions to customer (e.g., your employer).

Our Privacy Statement complies with the Daimler Truck AG Data Protection Code of Conduct applicable company-wide for Daimler Truck AG.

  1. 1. THIRD-PARTY WEBSITES.

    Our Sites may include links to other, third-party websites which are out of our control and are not covered by this Privacy Statement. These sites have their own privacy and information security policies and terms and conditions. Please review the privacy policy and terms and conditions sections of such websites for additional details.

  2. 2. PERSONAL INFORMATION WE COLLECT.

    We collect certain Personal Information when you use the Sites and Services for example, to request information from us, browse the Sites, sign up for marketing, or subject Customer Data (defined below) in conjunction with certain service offerings.

    • 2.1 Information provided by you.

      DTNA has no direct control or ownership of Personal Information provided by customers. Customers are responsible for complying with any laws and regulations that require obtaining consent or providing notice and disclosure before sharing any data with DTNA.

      • Identifiers, including name, postal address, email address, phone number, and other contact methods you provide to us.
      • Information in Customer Records, including name, address, phone number, and payment information.
        • You may be required to provide financial and bank information prior to placing an order through the Services. We use a third-party service provider to manage our purchase order website and to manage payments when you make purchases. Information you provide when making online purchases is shared with our third-party service providers so that your payment can be processed and your order can be fulfilled.
      • Customer Data, including vehicle data consisting of Personal Information and non-Personal Information uploaded from our customers collected via use of certain service offerings, including without limitation our Dealer Portal and Detroit Connect services.
      • Account Information, including vehicle configurations and fleet information. We store Account Information for as long as your account is active. You may modify your accounts at any time by visiting the “Profile” settings and making changes to individual fields.
      • Email Communications, we store all email correspondence between you and us in order to improve your future experiences.
    • 2.2 Personal Information automatically collected by the Sites.

      We may use cookies, tags, web pixels, and similar technologies to automatically collect information on our Sites. Information within this section describes our use of these technologies and your ability to control the use of these technologies. For more information, please refer to our Cookie Policy.

      1. Cookies. Cookies are small web files that a website or its provider transfers to your device’s hard drive, through your web browser, that enables the site’s or provider’s system to recognize your browser and remember certain information. “First-party cookies” are cookies set by us on the Sites. “Third-party cookies” are cookies set by other companies whose functionality is embedded into our Sites (for example, those set by Google). Generally, we may use first-party and third-party cookies for the following purposes: to make our Sites function properly; to provide a secure browsing experience during your use of our Sites; to collect passive information about your use of our Sites; to measure how you interact with our marketing campaigns; to help us improve our Services; and to remember your preferences for your convenience.
      2. Web Pixels. To see how successful our marketing campaigns or other goals of the Sites are performing, we may use conversion pixels, which fire a short line of code to tell us when you have clicked on a particular button or reached a particular page. We may also use web pixels to analyze usage patterns on our Sites. The use of a pixel allows us to record that a particular device, browser, or application has visited a particular webpage.
      3. Analytics. We may use third-party service providers to monitor and analyze the use of our Sites, such as Google Analytics. Such service providers often have their own separate privacy practices.
      4. Behavioral Remarketing. We may also use remarketing services to advertise on third-party websites to you after you visit our Sites. For this purpose, visitors are grouped by certain actions on our Sites, e.g., by duration of a visit. This enables us to understand your preferences and to show you personalized advertising even if you are currently surfing on another website that also participates in the same advertising network. We may utilize Google Ads and similar ad networks.
      5. Java Script. Pages of our Sites may also use Java scripts, which are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components; entity tags, which are HTTP code mechanisms that allow portions of websites to be stored or “cached” within your browser to accelerate website performance; and HTML5 local storage, which allows data from websites to be stored or "cached" within your browser to store and retrieve data in HTML5 pages when the website is revisited.
      6. Other Tracking Technologies. We may also use tracking technologies to collect "clickstream" data, such as the domain name of the service providing you with internet access, your device type, IP address used to connect your computer to the internet, your browser type and version, operating system and platform, the average time spent on our Sites, pages viewed, content searched for, access times and other relevant statistics, and assign unique identifiers to the device or other credentials you use to access the Sites for the same purposes.
      7. Live Chat. We may utilize a live webchat service provided and facilitated by our third-party providers. These providers may collect, use, store, share, disclose, place cookies, and protect customer information in accordance with their privacy policies. Information can include operator names and emails, visitor names and emails, visitor phone numbers, email addresses, and IP addresses.
      8. Do Not Track. Some browsers have a “Do Not Track” (DNT) feature that lets you tell websites and online services that you do not want to have your online activities tracked. Such browser features and industry standards are not uniform. As such, we do not monitor or respond to DNT browser requests.
      9. Location Information.

        • Geolocation, including IP address, approximate location, and precise geolocation. Certain Services may collect the below geolocation information through use of the Services:

          • Approximate Location, we may collect your approximate location for internal purposes, such as improving the Services and providing you with requested services.
          • Precise Geolocation, we may collect information that is used or intended to be used to locate you within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet. If you are located in a region which requires express consent, we will collect this precise geolocation data only with your consent and your consent will expire after a period of time and renewed consent will be required. If you choose to sell your DTNA device and service with location tracking enabled, it is your responsibility to immediately revoke your consent.
        • If you are using a mobile device, you may be able to adjust the settings of your device so that information about your physical location is not sent to us or third-parties by (a) disabling location services within the device settings; or (b) denying certain websites or mobile applications permission to access location information, by changing the relevant preferences and permissions in your device or browser settings.

      10. Your Choices. Your browser may provide you with the option to refuse some or all browser cookies. You may also be able to remove cookies from your browser. You can exercise your preferences in relation to cookies on our Sites by taking steps outlined below.

        • First-Party Cookies. You can use the browser with which you are viewing the Sites to enable, disable or delete cookies. To do this, follow the instructions provided by your browser (usually located within the "Help", "Tools" or "Edit" settings). Please note, if you set your browser to disable cookies, you may not be able to access certain secure areas of the Sites. Also, if you disable cookies, other parts of the Sites may not work properly.         • Third-Party Cookies.           • Google Analytics. We use Google Analytics on our Sites to help us analyze traffic and improve services.           • Google AdWords. Our Sites may use the Google AdWords remarketing service to advertise on third-party websites (including Google) to previous visitors to our Sites. That could mean that we advertise to previous visitors who haven’t completed a task on our Site. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to our Sites. Any data we collect will be used in accordance with this Policy, and Google is responsible to abide by its own privacy policy.           • Social Media & Search Pixels. We may use Meta Pixel tags and other social media and search pixels to better measure, optimize, and retarget our marketing campaigns. This allows user-specific behavior to be tracked after the user has been redirected to the advertiser’s website by clicking on a social media or search ad. This enables us to measure the effectiveness of social media and search ads for statistical and market research purposes. The data collected in this way is anonymous to us, in other words, we do not see the Personal Information of individual users. This data is stored and processed by the social media and search providers. The social media and search providers may link this information to your social media or search account and also use it for its own promotional purposes, in accordance with their data usage policies.     • 2.3 Personal Information collected via third-parties.

      We may purchase data, including Personal Information, from third-parties and combine this with Personal Information we have collected via your use of the Services.

      Some of our Services allow you to provide us with Personal Information relating to other parties, such as names, email addresses, postal addresses, or phone numbers (collectively, “Third-Party Data”). For example, you may provide us with personal information about someone else when placing a purchase order. If you use any feature of the Services that allows you to submit Third-Party Data, you acknowledge, represent, and agree (a) that you have the authority of the relevant other party for us to access and use the relevant Third-Party Data, and (b) that you have notified these other parties and informed them how their information is collected and used by us to provide the Services. We reserve the right to identify you as the person who has provided the information in any messages that are sent to other parties. We use Third-Party Data to (a) contact such party using the Third-Party Data provided, and/or (b) to provide the Services requested.

  3. 3. USE OF PERSONAL INFORMATION.

    DTNA processes your Personal Information for one or more of the following purposes:

    • To provide the Services to you;
    • To fulfill a service to you. For example, if you email us a question, we may use your email address to process your request and respond to your question;
    • To administer and provide the Services and Sites;
    • To offer you products from our affiliates, strategic partners, agents, or from third-party marketers and other unaffiliated parties that we believe may be of interest to you, or to assist such parties for research, administrative, and/or business purposes. These parties may contact you with an offer or advertisement related to a product or service, or they may use such information for their own research, administration or business purposes;
    • To complete your purchase or transaction;
    • To monitor and analyze trends and aggregate information;
    • To protect and prevent against fraud and misuse of the Services and Sites;
    • Send updates, newsletters, requests for surveys, and notifications to you relating to the Sites, the Services, special events, or contests;
    • Send marketing communications to you, like an email, subject to applicable laws;
    • To fulfill any other purpose for which you provide it;
    • To fulfill other purposes disclosed at time of collection;
    • To fulfill any legal or regulatory requirements and any of our internal policies;
    • As set forth in a separate agreement between you and us;
    • For any other purpose with your consent; and
    • As otherwise set forth in this Privacy Statement.
  4. 4. DISCLOSURE OF PERSONAL INFORMATION.

    Except as otherwise described in this Privacy Statement, DTNA will not sell Personal Information that we collect from the Services to any third-party for monetary or other valuable consideration, unless notice has been provided and only with your consent:

    • Subsidiaries and Affiliates. We may disclose Personal Information about you to our subsidiaries and affiliates.
    • Service Providers & Contractors. To help us provide superior service, your Personal Information may be shared with our service providers, contractors, and other third-parties we use to support our business. Such third-parties may, among other things, help us with aspects of our business such as order processing and fulfillment, fraud prevention, providing customer service, maintaining and analyzing data, sending customer communications on our behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes, and other promotions.
    • Payment Processors. We may disclose Personal Information about you to our third-party payment processors to facilitate and complete your order or transaction.
    • Analytics & Advertising Partners. We may share your Personal Information, including without limitation your contact information with entities that perform marketing or data aggregation services on our behalf, or with which we or an affiliate has joint marketing arrangements. We may share Personal Information, including without limitation your device information, location, usage data, and IP address, to analytics-based technologies to assist with personalization, advertising, and marketing. These technologies capture how you interact with our Sites and Services through behavioral metrics to improve and market our Services.
    • Authorized Representatives. If another individual is managing your account with us or your email account which the Services connect to on your behalf (for example, a manager managing the account of an employee), as authorized by you or as a personal representative under applicable law, that person can view all Personal Information about you on the Services.
    • In the Event of Merger, Sale, Divestitures, or Change of Control. We reserve the right to transfer Personal Information to a buyer or other successor in interest that acquires rights to that information as a result of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of us or substantially all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred.
    • With Your Consent. We may share your Personal Information for other purposes pursuant to your consent or at your direction.
    • Other Disclosures. We may disclose your Personal Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) to comply with the law; (ii) to respond to claims; to comply with legal process served on DTNA, its affiliates, subsidiaries, or our parent company Daimler Truck AG (e.g., a lawful subpoena, warrant, or court order); (iii) to enforce or apply our policies or agreements (including to bill and collect payments) (all of which are incorporated into and made a part of this Privacy Statement by reference); (iv) fulfill the purpose for which you provide it; (v) detect, prevent, or otherwise address fraud or security issues; or (vi) protect against harm to our, your, or third-parties’ rights, property, or safety.

    We may share and disclose de-identified and/or aggregate analytics with third-party partners for any legal purpose, including, when and where applicable, sharing and disclosing non-personally identifiable information combined with Personal Information.

  5. 5. PUBLIC FORUMS.

    We may provide public areas on the Services, such as forums, message boards, and chat rooms (“Public Forum”), where you can post information about yourself and others. Please exercise discretion and use caution with respect to your information, especially in such public areas. We do not control who reads postings on the Services, or how they may use or disclose such information. If you choose to voluntarily disclose information on Public Forums, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION ABOUT YOURSELF OR OTHERS IN PUBLIC FORUMS. WE ARE NOT RESPONSIBLE FOR THE USE OR DISCLOSURE OF SUCH INFORMATION.

  6. 6. SURVEYS, CONTESTS, PROMOTIONS, AND GIVEAWAYS.

    You may be asked to participate in surveys about your experience with the DTNA Services. When participating in surveys, any information you provide in the comments field will be shared with us, so please do not include any sensitive Personal Information or other information you do not wish to share.

    We may conduct giveaways, contests and other promotions on the Services in which we may ask you for additional information in order to participate. We use and treat this information in accordance with the terms of this Privacy Statement. We may also transfer your Personal Information to certain ad partners that you have explicitly requested to receive information from. Participation in such giveaways and contents is not necessary to use the Services, and you may choose whether you wish to participate in any particular giveaway or contest, without affecting your general use of the Services. You should carefully review the official rules of any promotion, sweepstakes, or contest in which you participate, including any option to opt-out of receiving special offers and marketing material..

  7. 7. DATA RETENTION.

    DTNA will retain your Personal Information only as long as needed to provide you with the Services or as necessary to comply with legal obligations, enforce agreements, or to resolve disputes. Data collected pursuant to a service is retained in accordance with the terms of the agreement for that service.

  8. 8. CHILDREN.

    The DTNA Sites and Services are neither designed for nor targeted to children under the age of 13. If you are under the age of 13, do not provide your Personal Information through the DTNA Sites or Services. If you believe your child has impermissibly provided us with their Personal Information, please contact us, so that we can identify and delete their information.

  9. 9. SECURITY.

    We use commercially reasonable administrative, technical, and physical safeguards to protect Personal Information collected through the DTNA Sites and Services.

  10. 10. INTERNATIONAL TRANSFER.

    The Services are hosted in the United States and are intended solely for visitors located within the United States. If you do not reside in the United States and provide Personal Information to us, please note that your Personal Information will be transferred, processed, collected, used, accessed, and/or stored in the United States, a country and jurisdiction that may not have the same data protection laws or rights as the country in which you reside, and subject to U.S. laws. Please do not sign up for the Services and provide your Personal Information to us if you do not consent to this information to be transferred or processed outside of your country, or if the laws in your country restrict such transfers.

  11. 11. CALIFORNIA SUPPLEMENT (California Residents).

    This section is applicable to residents of California, which provide residents with certain rights regarding Personal Information (“consumers” or “you”). This section uses certain terms that have the meaning given to them under California’s state privacy law, including ‘Personal Information’, which shall be used interchangeably with privacy laws that similarly define ‘Personal Data’. The following do not apply to individuals who do not live in California on a permanent basis.

    • 11.1 SHINE THE LIGHT

      Under California Civil Code Section 1798.83 (“Shine the Light”), California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personal Information, such as name, e-mail and mailing address and the type of services provided to the customer, that a business has disclosed to third-parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third-parties’ direct marketing purposes; and (b) the names and addresses of all such third-parties. To request the above information, please contact us as directed in the CONTACT US section below with a reference to California Disclosure Information.

    • 11.1 SHINE THE LIGHT

    • 11.2 CALIFORNIA CONSUMER PRIVACY ACT OF 2018, AS REVISED AND UPDATED BY THE CALIFORNIA PRIVACY RIGHTS ACT (COLLECTIVELY, “CCPA”)

      Personal Information for purposes of this section of the Privacy Statement does not include:

      • Publicly available information from government records or news stories.
      • De-identified or aggregated consumer information.
      • Other information excluded from the CCPA’s scope, such as:
        • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
        • Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
      1. Collection, Disclosure, and Retention of Personal Information

        The Personal Information we collect and the sources from which we collect, disclosure information, and retention information are described in the above sections of this Privacy Statement.

      2. Selling and Sharing Personal Information

        We do not sell or share your Personal Information in exchange for monetary consideration; however, we may use tools described above such as Google Analytics, which may be interpreted as sharing your Personal Information. As such, please reference the above YOUR CHOICES for opt out rights regarding these tools.

      3. CCPA Consumer Rights

        Under CCPA, consumers have certain rights regarding their Personal Information, as described below.

        • Right of Access: You have the right to request, twice in a 12-month period, that we disclose to you the following information about you, limited to the preceding twelve (12) months:
            • The categories of Personal Information that we collected about you;
            • The categories of sources from which the Personal Information is collected;
            • The business or commercial purpose for collecting or selling Personal Information;
            • The categories of third-parties with whom we share Personal Information;
            • The specific pieces of Personal Information that we have collected about you;
            • The categories of Personal Information that we disclosed about you for a business purpose or sold to third-parties; and
            • For each category of Personal Information identified, the categories of third-parties to whom the information was disclosed or sold.
        • Right of Deletion: You have the right to request that we delete any Personal Information about you which we have collected from you, subject to exceptions within the law.
        • Right to Opt-Out: You have the right to opt-out of the disclosure of Personal Information about you for monetary or other valuable consideration. However, we do not sell your Personal Information in exchange for monetary consideration. We may use tools described above such as Google Analytics, which may be interpreted as sharing your Personal Information. As such, please see the above YOUR CHOICES section for more information regarding opting out of the use of these tools.
        • Right to Opt-In: We do not have actual knowledge that we collect, share, or sell the Personal Information of minors under the age of 16 without proper consent of a parent or guardian.
        • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to request specific limitations on further sharing, use, or disclosure of your Sensitive Personal Information that is collected or processed for certain reasons outside of providing the Services. However, we do not collect or process Sensitive Personal Information for any of these reasons.
        • Right to Correction: You have the right to request that we maintain accurate Personal Information about you and correct any Personal Information about you which we have collected from you, subject to exceptions within the law.

        If you would like to exercise any of the rights provided, please refer to the CONSUMER REQUESTS AND VERIFICATION section below.

    • 11.3 CONSUMER REQUESTS AND VERIFICATION

      To exercise your consumer rights, please submit a verifiable consumer request to us by sending us a message to DTNAprivacy@daimlertruck.com. The verifiable consumer request must provide sufficient information that allows DTNA to reasonably verify you are the person about whom DTNA collected Personal Information or an authorized representative.

      1. Right to Non-Discrimination

        We may not discriminate against you because you exercise any of your privacy rights contained in this Privacy Statement including, but not limited to:

        • Denying goods or services to you;
        • Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
        • Providing a different level or quality of goods or services to you; or
        • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

        However, DTNA may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive DTNA offers will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

      2. Verifying Requests

        You may request to exercise your rights of access, deletion, or correction by contacting us as described in the CONTACT US section below. To help protect your privacy and maintain security, we will take steps to verify your identity before processing your request. If you request access to or deletion of your Personal Information, we may require you to provide any of the following information: your email and phone number, customer information, and/or account sign-up authentication or other information needed to verify your identity depending on the sensitivity of the Personal Information that is the subject of the request. When you make such a request, you can expect the following:

        • As required under applicable law, we will verify your identity. You will need to provide us with your email address and full name. We may ask for additional information if needed.
        • We will confirm that you want your information accessed, corrected, and/or deleted.
        • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
        • We will respond to your request within 45 days upon receipt of your request. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
        • In certain cases, a request for access, correction, or deletion may be denied. If we deny your request, we will explain why we denied it and delete any other information that is not protected and subject to denial.
      3. Authorized Agents

        You may designate an authorized agent to request any of the above rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us as described in the CONTACT US section below to make a request on your behalf. Even if you choose to use an agent, we may, as permitted by law, require:

        1. Provide the authorized agent written permission to do so; and
        2. Verify your own identity directly with DTNA.

        DTNA will not require these steps if we have received proof that you have provided the authorized agent with a power of attorney pursuant to California Probate Code sections 4000 to 4465. DTNA may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf. DTNA may also deny a request from an agent that does not meet the requirements for authorized agents under the CCPA.
